Membership Agreement

Parties

a) ...KAZIM KARABEKİR MAH. 2.KOÇ SK. NO: 28 YILDIRIM / BURSA... A.Ş. (hereinafter referred to as Asilgüç), operating the website www.asilguc.com.tr. b) Internet user who is a member of the website www.asilguc.com.tr ("Member").

Subject of the Agreement

The subject of this Agreement is to determine the conditions of the member's use of the website www.asilguc.com.tr owned by Asilgüç.

Rights and Obligations of the Parties

3.1. The Member declares and undertakes that the personal and other information provided while registering on the website www.asilguc.com.tr is true before the law, and that they will fully and immediately compensate Asilgüç for all damages that may arise due to the inaccuracy of this information. 3.2. The Member cannot give the password given to them by Asilgüç to other persons or organizations; the right to use the said password belongs exclusively to the Member. Therefore, Asilgüç reserves all rights to compensation and other claims arising from this unauthorized use, against all claims and demands that may be brought against Asilgüç by third parties or authorized authorities. 3.3. The Member agrees and undertakes in advance to comply with the provisions of the legal legislation while using the website www.asilguc.com.tr and not to violate them. Otherwise, all legal and criminal obligations that may arise will be entirely and exclusively binding on the Member. 3.4. The Member cannot use the website www.asilguc.com.tr in any way that disrupts public order, violates general morality, disturbs or harasses others, for an illegal purpose, or in a way that infringes on the intellectual and copyright of others. Additionally, the member cannot engage in activities (spam, viruses, trojan horses, etc.) and transactions that prevent or hinder others from using services. 3.5. The opinions and thoughts expressed, written, and used by members on the website www.asilguc.com.tr are entirely their own personal views and are binding on the opinion holder. These opinions and thoughts have no relation or connection with Asilgüç. Asilgüç has no responsibility for damages that may be suffered by third parties due to the opinions and thoughts expressed by the member, and for damages that may be suffered by the member due to the opinions and thoughts expressed by third parties. 3.6. Asilgüç will not be responsible for the reading of member data by unauthorized persons and for damages that may occur to member software and data. The Member agrees in advance not to demand compensation from Asilgüç for any damage they may suffer due to the use of the website www.asilguc.com.tr. 3.7. The Member agrees not to access or use the software and data of other internet users without permission. Otherwise, the legal and criminal responsibilities arising from this belong entirely to the Member. 3.8. The Member who violates one or more of the articles listed in this membership agreement is personally responsible criminally and legally for this violation and will keep Asilgüç free from the legal and criminal consequences of these violations. Additionally, if the event is transferred to the legal field due to this violation, Asilgüç reserves the right to demand compensation from the member for non-compliance with the membership agreement. 3.9. Asilgüç has the right to delete the member's membership and delete customer files, documents, and information at any time unilaterally when necessary. The Member accepts this action in advance. In this case, Asilgüç has no responsibility. 3.10. The software and design of the website www.asilguc.com.tr are the property of Asilgüç, and the copyright and/or other intellectual property rights related to them are protected by the relevant laws, and they cannot be used, acquired, or changed by the member without permission. Other companies and products mentioned on this website are the trademarks of their owners and are also protected under intellectual property rights. 3.11. Asilgüç may collect certain information such as the name and Internet Protocol (IP) address of the Internet service provider used to access the site, the date and time the site was accessed, the pages accessed while on the site, and the Internet address of the website that provides direct connection to the site, in order to improve and develop the website www.asilguc.com.tr and/or within the framework of legal legislation. 3.12. Asilgüç may disclose the member's personal information when requested as a legal obligation, or when it believes in good faith that it is necessary to (a) act in accordance with legal requirements or comply with legal procedures notified to Asilgüç; (b) protect and defend the rights and property of Asilgüç and the Asilgüç website family. 3.13. Asilgüç has taken measures within the available means to ensure that the website is free from viruses and similar malicious software. In addition, the user must provide their own virus protection system and provide the necessary protection to ensure ultimate security. In this context, by entering the Asilgüç website, the member is deemed to have accepted that they are responsible for all errors that may occur in their own software and operating systems and their direct or indirect consequences. 3.14. Asilgüç reserves the right to change the content of the site at any time, change or terminate any service provided to users, or delete user information and data registered on the Asilgüç website. 3.15. Asilgüç may change, update, or cancel the terms of the membership agreement at any time without any prior notice or warning. Every provision that is changed, updated, or repealed will be effective for all members as of the date of publication. 3.16. The Parties agree and declare that all computer records belonging to Asilgüç will be taken as the sole and true exclusive evidence, in accordance with Article 287 of the Civil Procedure Law, and that these records constitute an evidence agreement. 3.17. Asilgüç, in accordance with this membership agreement, has the authority to send information emails to the registered email addresses of its members and information SMS to their mobile phones, and by approving this membership agreement, the member will be deemed to have accepted the sending of information emails to their email address and information SMS to their mobile phone.  

Termination of the Agreement

This agreement will remain in effect until the member cancels their membership or until their membership is canceled by .... Asilgüç may unilaterally terminate the agreement by canceling the member's membership if the member violates any provision of the membership agreement.  

Resolution of Disputes

Istanbul Courts and Enforcement Offices are authorized in disputes related to this agreement.

Validity

The member's registration means that the member has read all the articles in the membership agreement and accepts the articles in the membership agreement. This Agreement has been concluded and mutually entered into force at the moment the member becomes a member.
